Supreme Court rejects review in broker liability case, leaving the issue unresolved

The Supreme Court has again rejected a review of the question of broker liability in a case involving the death or injury of a person struck by a truck that was booked by a 3PL.

However, unlike the case of Miller v. C.H. Robinson, this rejection is considered a victory for the brokerage industry.

In a long list of denials of certiorari posted Monday, the court without comment said it would not review the appeal brought by Ying Ye, the widow of a man killed in 2017 in an accident in Texas. Ye’s...

Will Supreme Court resolve conflicting rulings on broker liability?

Now the wait begins.

There is no clear timeline for when the U.S. Supreme Court will rule on a review petition filed earlier this month by Ying Ye, the widow of a man killed by a truck that was brokered by GlobalTranz.

The 7th U.S. Circuit Court of Appeals ruled in July that the Federal Aviation Administration Authorization Act (F4A) blocked GlobalTranz from being held liable for the death of Shawn Lin, Ye’s husband. Lin was riding a motorcycle in November 2017 when he collided with a truck...

Loaded and Rolling: Freight media’s evolving landscape on display at F3

Freight media’s evolving landscape on display at F3

(Photo: Jim Allen/FreightWaves)

The changing freight media landscape was on full display at the F3: Future of Freight Festival last week in Chattanooga Tennessee, as influencers, salespeople, presenters and executives intermingled during and after the events. One topic discussed is the changing way media is being consumed and how traditional legacy media outlets are responding to tech-savvy upstarts. While at the event, I noted that for...

3PLs get fresh legal win in fight to block liability in truck accidents

A brokerage has once again been found not to be liable for a fatal accident, adding to a conflicting body of law that the legal industry hopes may eventually make its way to the Supreme Court.

And to add a twist to the case involving UPS (NYSE: UPS) subsidiary Coyote Logistics, the load in question was double brokered, and Coyote didn’t hire the carrier involved in the October 2020 wreck on Interstate 81 in Lackawanna County, Pennsylvania. Not only that, the decision by Judge Karoline Mehalchick...

Broker dodges liability in $18M verdict, had no ‘control’ over carrier

In a case with strong parallels to C.H. Robinson vs. Miller and the case known simply as Ye, an Illinois appellate court has removed a 3PL from a more than $18 million decision against a carrier whose truck struck a teenager in 2016.

The Appellate Court for the 1st District of Illinois removed 3PL Alliance Shippers from the verdict handed down in the case of Francine Cornejo vs. Dakota Lines (the carrier), Gordon Lewis (the driver) and Alliance. Cornejo is the mother of Gustavo Cornejo, a minor...

Reducing waste, manual touches ‘big opportunity’ for C.H. Robinson

With the fall season for investment conferences kicking off within the first days after Labor Day, it also means that new C.H. Robinson CEO Dave Bozeman is taking to the road to make his case about how to engineer a rebound at the country’s largest 3PL.

At the TD Cowen conference in Boston Thursday, Bozeman returned to many of the same themes that he addressed during his first quarterly earnings call with analysts in August, though with another month of experience under his belt. Bozeman took...

Landstar model partially insulated from spot rate chaos

A blue rig hauling a Landstar trailer on the highway

Freight broker Landstar System achieved more financial records during the 2022 first quarter. Fresh highs in revenue, gross profit and net income were some of the highlights. The Jacksonville, Florida-based company reported earnings per share of $3.34 in the quarter, well ahead of the initial guidance range of $2.70 to $2.80 provided at the end of January.

President and CEO Jim Gattoni addressed recent weakness in the spot truckload market on a call with analysts Thursday. He said the declines...
