Feds told to start rating ‘unrated’ trucking companies for safety

WASHINGTON — Major trucking companies and brokers who book their freight are pressuring the Federal Motor Carrier Safety Administration to attach a safety rating to carriers operating without such a rating — a situation that exists for over 90% of the freight market.

The concern comes as FMCSA looks at developing a new way to verify when a motor carrier is fit to operate trucks in interstate commerce, known as a safety fitness determination (SFD). The agency issued a preliminary advance notice...

FMCSA tightens regulations to prevent fraud by brokers

WASHINGTON — Trucking companies should be better protected against unpaid claims that are due them from brokers under a new rule issued by the Federal Motor Carrier Safety Administration.

The rule, proposed earlier this year and made final on Wednesday, amends regulations addressing broker and freight forwarder responsibility.

“This final rule will result in benefits to motor carriers resulting from a decrease in the claims against brokers that go unpaid,” FMCSA stated.

“FMCSA will immediately...

Capitol Hill panel debates truck speed limiters, broker fraud

WASHINGTON — At a Capitol Hill hearing on regulations that keep the trucking industry from efficiently moving the nation’s freight, owner-operator representatives testified that the biggest impediment may be a speed limiter regulation yet to be rolled out.

“All kinds of studies show that when all traffic flows at the same speed, it’s much safer for everyone,” Lewie Pugh, executive vice president of the Owner-Operator Independent Drivers Association, told the highway subcommittee of the House...

FMCSA proposes tougher rules for truck broker financial backing

The Federal Motor Carrier Safety Administration is proposing more oversight of truck brokers and freight forwarders and the surety bond and trust companies that back them up in an effort to ease the monetary pain they can inflict on motor carriers.

“FMCSA believes that most brokers operate with integrity and uphold the contracts made with motor carriers and shippers,” the proposal states. “However, a minority of brokers with unscrupulous business practices can create unnecessary financial...

FMCSA updates guidelines for brokers, dispatch services

Federal regulators have attempted to clarify differences between brokers, bona fide agents and dispatch services in new interim guidelines issued Tuesday by the Federal Motor Carrier Safety Administration.

Mandated by last year’s infrastructure bill, the guidelines are aimed at cracking down on companies that engage in truck brokering but without proper authority from FMCSA, an issue that brokers claim illegally undercuts their business.

While FMCSA acknowledged that dispatch services “can help...

FMCSA commenters debate whether load boards should register as brokers

Should electronic bulletin boards — known in trucking as load boards — be considered brokers and therefore required to register as such with federal regulators?

The question was posed by the Federal Motor Carrier Safety Administration in soliciting comments for future guidance on how freight brokers, bona fide agents and truck dispatchers should operate.

Most responding to that question in the petition, which received over 70 comments of which many were duplicate form-letter responses, believed...
