Two rail unions want a federal court to dismiss BNSF’s lawsuit over its ability to implement a COVID-19 vaccine mandate. Instead, they want the court to compel the railroad to negotiate any vaccine requirements.

The Brotherhood of Locomotive Engineers and Trainmen (BLET) and the International Association of Sheet Metal, Air, Rail and Transportation Workers – Transportation Division (SMART-TD) contend that the company’s vaccine mandate violates the Railway Labor Act (RLA).

Union Pacific, Norfolk Southern vaccine lawsuits combined in court

Ongoing lawsuits between railroad unions and two Class I railroads over requiring employees to get the COVID-19 vaccine have been consolidated in federal court.

The U.S. District Court for the Northern District of Illinois on Nov. 17 combined two proceedings, one involving Union Pacific (NYSE: UNP) and the other involving Norfolk Southern (NYSE: NSC), according to a Monday update from the Brotherhood of Locomotive Engineers and Trainmen (BLET). Add BNSF to the list of Class I railroads that are jostling with rail unions in court over implementing the COVID-19 vaccine mandate.

BNSF (NYSE: BRK.B) filed a lawsuit Sunday with the U.S. District Court for the Eastern District of Illinois asking the court to agree with the railroad’s interpretation of the Railway Labor Act when it comes to complying with federal mandates. Union Pacific, unions spar over vaccine mandate rollout

Union Pacific and rail union members are sparring in federal court over how UP should implement a federal mandate requiring certain companies to ensure their employees are vaccinated against COVID-19 by Dec. 8.

US Circuit Court rejects FRA’s actions on train crew size
