FMC tightens rules on charging container late fees

The Federal Maritime Commission has imposed new billing standards on ocean carriers and terminal operators in an effort to crack down on abusive container late fees.

The new requirements focus on demurrage — fees charged by carriers and container terminals when full containers have not been picked up by customers within a certain number of days — and detention, the fees charged to customers if they are late returning the empty container back to the terminal.

NFI Industries announced Monday the acquisition of port services provider MCO Transport. Financial terms of the transaction were not disclosed.

Wilmington, North Carolina-based MCO provides container drayage, warehousing and truckload transportation out of terminals near the ports in Savannah, Georgia; Charleston, South Carolina; and Norfolk, Virginia. It has facilities in Atlanta and Wilmington as well.

California intermodal trucker suing Hapag-Lloyd over detention fees

A California drayage business is suing Germany’s Hapag-Lloyd for allegedly forcing the trucking company to store empty refrigerated containers without getting paid.

According to a complaint filed this week at the Federal Maritime Commission, Long Beach-based Orange Avenue Express (OAE) also asserts that the ocean carrier has so far racked up $258,000 in detention charges against OAE that the trucking company asserts violate federal shipping regulations.

A federal maritime regulator is ordering the world’s largest containership companies to provide her agency with container detention and demurrage information to ensure they’re meeting their legal obligations.
