On Tuesday, American Trucking Associations released its latest driver compensation study, which showed continued increases in driver pay in the past two years despite a deterioration in freight market conditions. The survey collected the data of over 120 fleets, which comprised more than 150,000 employee drivers and 14,000 independent contractors.

Key findings in the the survey:

Debate on valuing freight for state income tax purposes heats up

A battle over the complex issue of how states tax the value of freight movements and deliveries may soon reach a climax, with significant resistance to change coming from the trucking sector.

On one side of the argument is a push by some states, notably California, to move away from what is known as a “mileage approach” and instead to a “pickups and deliveries approach.” The latter is also known as a destination-based system.

The dispute is completely about trucking; it is not part of a wider tax...

ATA’s Chris Spear earns $1.9M, but where are his results?

In May, the American Trucking Associations’ board of directors unanimously voted to extend the contract of current ATA President and CEO Chris Spear through 2029. The ATA, in a news release, cited Spear’s efficacy in advancing the legislative agenda of its membership as the reason behind his tenure extension.

But looking at public statements from both the ATA and Spear himself, it is less than clear that the ATA is an effective advocate for its membership.

Take, for example, an April 2023 press...

ATA red-flags DOJ’s proposed marijuana policy change

WASHINGTON — The Biden administration’s anticipated move to recategorize marijuana from a Schedule I to a Schedule III drug under the Controlled Substances Act will likely lead to more truck crashes unless safeguards are put in place, the American Trucking Associations has warned.

White House press secretary Karine Jean-Pierre announced the Justice Department’s notice of proposed rulemaking (NPRM) to reschedule the drug at a press briefing on Thursday.

“If finalized, marijuana will no longer hold...

Biden administration acknowledges ‘challenge’ with new truck emissions rule

WASHINGTON — The Biden administration acknowledged that its aggressive push to decarbonize trucking will be costly — but that the federal government will be here to help.

“The overarching challenge is aligning the market-driven desire from fleets to adopt zero-emission freight vehicles with the resources required to make it successful, and right now, they cost more,” said Gabe Klein, executive director of the U.S. Joint Office of Energy and Transportation.

FedEx warns of higher costs under trucker rest break waivers

WASHINGTON — FedEx Corp. predicts higher costs on its linehaul and delivery routes as well as those of rivals if the Biden administration approves waivers governing truck driver meal and rest breaks in California and Washington.

In comments filed with the Federal Motor Carrier Safety Administration, FedEx (NYSE: FDX) asserted that if the FMCSA were to waive its preemption over the two states’ meal and rest break (MRB) laws — which would make interstate carriers subject to the stricter state...

FMC tightens rules on charging container late fees

The Federal Maritime Commission has imposed new billing standards on ocean carriers and terminal operators in an effort to crack down on abusive container late fees.

The new requirements focus on demurrage — fees charged by carriers and container terminals when full containers have not been picked up by customers within a certain number of days — and detention, the fees charged to customers if they are late returning the empty container back to the terminal.

Starting May 26, container ship...
