Freight Essentials urges industry to speak up in WWEX legal fight

Freight Essentials is pushing back against WWEX Group’s effort to maintain redactions in the third amended petition to Freight Essentials’ lawsuit against WWEX.

WWEX and its affiliates, Worldwide Express, GlobalTranz and Unishippers, filed a motion on Dec. 17 to maintain the redactions and seal the unredacted version.

The defendants argue that certain details in the lawsuit contain sensitive business information that, if disclosed, could harm their competitive position, but Freight Essentials, a...

C.H. Robinson – and 3PL industry – win another broker liability case in 7th Circuit

The 3PL industry’s latest win in the legal battle over broker liability comes in a federal appellate court where a pro-broker precedent already exists.

Meanwhile, the latest attempt to have the U.S. Supreme Court rule on the issue may have been taken up by the court in a conference held Friday.

In the most recent case, the U.S. Court of Appeals for the 7th Circuit, in a decision handed down Jan. 3, held that C.H. Robinson (NASDAQ: CHRW) did not have an “agency” relationship with carrier Caribe...

Despite win on appeal, TQL wants Supreme Court to review broker liability issue

In an unusual twist, giant brokerage TQL is asking the U.S. Supreme Court to review its lower court victories on the question of broker liability.

In a brief filed with the Supreme Court last week, TQL sided with its adversary Katia Gauthier in seeking review of the lower court cases. Her husband, Peter, was killed in May 2020 in a collision with a truck hired by TQL.

Gauthier’s subsequent lawsuit against the carrier and TQL resulted in a pair of decisions – in the U.S. District Court for the...

Another win for brokers: no liability for Echo Global in SC fatal crash

Another recent court case is adding to the growing pile of legal precedents protecting brokers from any liability created from a crash involving a carrier hired by a 3PL.

In the most recent case, Echo Global Logistics was granted its request for summary judgement to be removed as a defendant from a case in the U.S. District Court for South Carolina. In the Nov. 15 ruling, Judge Jacquelyn Austin granted that motion, citing the Federal Aviation Administration Authorization Act (F4A) as the basis...

Supreme Court rejects review in broker liability case, leaving the issue unresolved

The Supreme Court has again rejected a review of the question of broker liability in a case involving the death or injury of a person struck by a truck that was booked by a 3PL.

However, unlike the case of Miller v. C.H. Robinson, this rejection is considered a victory for the brokerage industry.

In a long list of denials of certiorari posted Monday, the court without comment said it would not review the appeal brought by Ying Ye, the widow of a man killed in 2017 in an accident in Texas. Ye’s...

GlobalTranz wants Supreme Court to punt on broker liability issue

GlobalTranz wants the Supreme Court to let more time pass and possibly more legal decisions to come down before the nine justices weigh in on the question of broker liability.

That GlobalTranz would argue against the high court granting certiorari review to the appeal of Ying Ye is not surprising. Ye’s case against GlobalTranz for its actions in hiring Global Sunrise, the carrier involved in a 2017 accident that killed her husband, failed in both the U.S. District Court for the Northern District...

Will Supreme Court resolve conflicting rulings on broker liability?

Now the wait begins.

There is no clear timeline for when the U.S. Supreme Court will rule on a review petition filed earlier this month by Ying Ye, the widow of a man killed by a truck that was brokered by GlobalTranz.

The 7th U.S. Circuit Court of Appeals ruled in July that the Federal Aviation Administration Authorization Act (F4A) blocked GlobalTranz from being held liable for the death of Shawn Lin, Ye’s husband. Lin was riding a motorcycle in November 2017 when he collided with a truck...

Broker dodges liability in $18M verdict, had no ‘control’ over carrier

In a case with strong parallels to C.H. Robinson vs. Miller and the case known simply as Ye, an Illinois appellate court has removed a 3PL from a more than $18 million decision against a carrier whose truck struck a teenager in 2016.

The Appellate Court for the 1st District of Illinois removed 3PL Alliance Shippers from the verdict handed down in the case of Francine Cornejo vs. Dakota Lines (the carrier), Gordon Lewis (the driver) and Alliance. Cornejo is the mother of Gustavo Cornejo, a minor...

Different court findings of broker liability raise prospect of another Supreme Court trip

A decision handed down Tuesday in favor of 3PL GlobalTranz sets up the possibility of another attempt to have the Supreme Court review the issue of broker liability when things go horribly wrong on the road.

The 7th Circuit Court dismissed an appeal from Ying Ye, the widow of Shawn Lin, who was killed in November 2017 while riding a motorcycle that collided with a truck operated by carrier Global Sunrise. That carrier, with a safety record described in the court documents as less than stellar,...
