Robin Hutcheson discusses priorities for FMCSA

FMCSA Administrator Robin Hutcheson

Last month Robin Hutcheson was confirmed as the seventh administrator of the Federal Motor Carrier Safety Administration, but she has been leading the agency since January after acting administrator Meera Joshi left to become a deputy mayor of New York City.

It has been a busy year for Hutcheson since then. Barely a week after she took the wheel at FMCSA, the U.S. Department of Transportation rolled out its National Roadway Safety Strategy, an agency-wide initiative aimed at tackling road...

FMCSA considering 5-year ‘special’ waiver for propane haulers

Propane truck at terminal.

Extending the limits on truck driver hours-of-service restrictions will help propane haulers respond to spikes in consumer demand, according to an exemption request to be considered by federal regulators.

The Federal Motor Carrier Safety Administration is giving the public 30 days to comment on the request, submitted by the National Propane Gas Association (NPGA), a 2,500-member organization based in Washington, D.C. A notice is scheduled to be published in the Federal Register on Friday.

As laid...

Trucking COVID-related supplies drops 50% under special waiver

Truck with livestock trailer.

New federal data reveals that COVID-19 supplies, such as tests, masks and related medical equipment, hauled under the emergency trucking hours-of-service (HOS) waiver have dropped by approximately 50% over nine months ending in July.

The new data, compiled by the Federal Motor Carrier Safety Administration, also shows that livestock and groceries — namely food and paper products — are the primary commodities being transported by truck under the waiver, based on a review of self-reported...

DC appeals court denies driver hours-of-service challenge

Electronic logging device in truck cab

The Federal Motor Carrier Safety Administration successfully defended changes to the trucking hours-of-service (HOS) regulations enacted two years ago against a challenge from safety groups and the Teamsters union alleging the changes increase crash risks and make the roads less safe.

In a petition filed in December last year, the union and the three safety groups — Advocates for Highway and Auto Safety (Advocates), Parents Against Tired Truckers, and Citizens for Reliable and Safe Highways —...

Truckers: Safety groups ignore driving ‘realities’

Representatives of small-business truckers have asked a federal appeals court to deny safety advocates’ challenge to hours-of-service (HOS) rule changes, saying the challenge is not based on truck-driving realities.

In a petition filed in support of the Federal Motor Carrier Safety Administration, the Owner-Operator Independent Drivers Association outlined how its members are benefiting from more flexibility provided by the changes — a somewhat rare occasion in which OOIDA, large carriers and...

Buttigieg’s DOT rejects hours-of-service court challenge claims

The Federal Motor Carriers Safety Administration has rejected assertions that hours-of-service revisions made in September 2020 will lead to more crashes despite claims made by safety advocates and labor.

Responding to a petition filed by the groups in December with the U.S. Court of Appeals for the District of Columbia Circuit, FMCSA and the U.S. Department of Transportation argued that the petitioners’ anti-safety claims lack standing and should be rejected.

“Even if petitioners had established...

Is FMCSA losing control of its safety mission?

Federal regulators are losing their grip on how they administer and oversee rules governing truckers, and it’s putting safety at risk, trucking and safety advocates warn.

In comments filed with U.S. Department on Transportation on the department’s draft strategic framework, the Commercial Vehicle Safety Alliance (CVSA), whose members include local, state and federal truck safety officials, contends that the Federal Motor Carrier Safety Administration “has fallen behind on its core responsibility...
