Punitive damages in huge Wabash judgment slashed but still over $100M

A court in Missouri rejected a wide variety of requests from trailer builder Wabash National arising from the lawsuit that led to one of the biggest nuclear verdicts ever in trucking and equipment, but the company did win a huge reduction in punitive damages.

The $450 million in punitive damages was slashed to $108 million by Judge Christoper McGraugh of the 22nd Judicial Circuit Court of Missouri in a decision handed down last week.

With trailer orders down, Wabash National gets negative outlook at S&P

Trailer manufacturer Wabash National, which has seen a sharp downturn in its financial measurements, has hung on to its credit rating from S&P Global, but its outlook has been lowered to negative by the ratings agency.

S&P said it was affirming Wabash’s BB- issuer credit rating. It also has a B+ issue-level rating on the company’s senior unsecured notes, as well as a recovery rating of 5. Those were both affirmed by S&P.

Wabash National hit with $462M verdict in trailer equipment case

Wabash National is evaluating its options in response to a $462 million verdict against the truck trailer manufacturer by a jury in Missouri state court. The case involves a fatal crash of a car into the back of a truck in 2019 in which two people in the car were killed.

Trailer orders ramp up in September, pushing existing bookings into 2022

Trailer manufacturers began to satiate pent-up fleet demand in September, but new bookings pushed the length of the backlog for delivery into 2022 amid uncertainties surrounding rolling supply shortages.

Preliminary reports from ACT Research show trailer manufacturers posted 28,500 net orders in September, a 130% gain from August but 45% behind September 2020, the third-highest orders in history.

Trailer orders tank in July as manufacturers struggle to find workers

A lack of workers, supply chain disruptions and the effective end of the order cycle combined to push new trailer orders down 58% year over year in July.

Manufacturers would have built more equipment to meet strong demand “if the supply chain would have been more robust,” Wabash National Corp. President and CEO Brent Yeagy told FreightWaves. 

“We have generally met our ramp targets for 2021,” he said. “We could have probably exceeded them based on the demand that we have.”

Wabash National bets big on dry vans, increases capacity by 20%

Wabash National Corp. is ramping down traditional refrigerated capacity and converting the floor space to add 20% more dry vans by 2023, counting on freight demand lasting well beyond the current peak.

“As we think about the past, present and future of our manufacturing footprint, we have found ourselves with demand [that] has exceeded physical capacity for the production of dry vans,” CEO Brent Yeagy said Wednesday on the company’s Q2 call with analysts.
